🎓 Appointment of Untrained Teacher

Every teacher appointed to an elementary school must have the prescribed minimum qualifications — no school can appoint an unqualified teacher.

What This Violation Looks Like

School appoints a "para-teacher" or "shiksha mitra" without NCTE-prescribed qualifications
Teacher does not have a D.Ed. / B.Ed. or equivalent qualification
Teacher without TET (Teacher Eligibility Test) clearance appointed in states where TET is mandatory
Same person teaching all subjects and classes without subject-specific qualification
Volunteer or "honorary" teacher working without any formal teaching qualification
School claims teacher is "qualified" but cannot produce NCTE-recognized qualification certificate

Why It Happens

Unqualified teachers are appointed because they are cheaper than trained teachers, or because the school cannot attract trained teachers for the salary offered, or because the school has deliberately avoided meeting the staffing norms.

Legal Definition & Penalty

Section 23(1) requires every teacher appointed after the commencement of the Act to possess the minimum qualifications as laid down by the National Council for Teacher Education (NCTE). Section 25 requires every school to maintain the pupil-teacher ratio prescribed in the Schedule. Appointing a teacher without NCTE minimum qualifications is a violation that affects the quality of education received by every child in that class.

Additional consequence: School can face loss of recognition under Section 19(5). Individual teachers can be removed from service.

Verify teacher qualifications

Ask the school for the teacher's qualification certificate. They are obliged to display teacher qualifications. You can also file an RTI to obtain this information.

File complaint with DEO

File a formal complaint with the DEO naming the school and teacher, and providing evidence of the unqualified appointment.

File with SCPCR

SCPCR can direct the school to appoint qualified teachers and initiate de-recognition proceedings if the school fails to comply.
