What Is the 25% Quota?

Section 12(1)(c) of the Right of Children to Free and Compulsory Education Act, 2009 is one of the most powerful provisions in Indian education law. It mandates that every private unaided school — regardless of its board, fees, or reputation — must fill at least 25% of its total intake at the entry level with children from disadvantaged groups and weaker sections. These children receive completely free education until Class 8.

The "entry level" typically means Class 1. In schools that also run a pre-primary section (Nursery, KG), the entry point may be at pre-primary level. Once admitted, the child does not need to reapply — free education continues automatically through Class 8.

The school is not providing this education as charity. It is legally obligated to do so, and the state government reimburses it for the cost. This reimbursement mechanism means no financial burden falls on the parent — not for admission, not for books, not for uniforms, not for exams. The child is entitled to participate in the full school experience on equal terms with every other student.

Admissions under the quota happen through a state-run lottery, not through school interviews or selections. The school cannot pick which children get the quota seats. This is by design — the lottery prevents discrimination and ensures that disadvantaged children have a genuine chance at quality private education.
