Capitation Fee

Any payment that a school demands or accepts beyond its officially notified fees is a "capitation fee" — regardless of what it's called: donation, development fee, building fund, activity fee, deposit, etc.

Any payment that a school demands or accepts beyond its officially notified fees is a "capitation fee" — regardless of what it's called: donation, development fee, building fund, activity fee, deposit, etc.

Schools cannot demand any payment beyond their officially published fee schedule. Any additional demand — no matter how it is labelled — is illegal under Section 13. The fine is up to 10 times the amount charged.

Examples
  • "Donation" of ₹50,000 for Class 1 admission = capitation fee
  • "Development fee" not in official fee schedule = capitation fee
  • "Building fund contribution" = capitation fee
  • "Activity fee" not in notified schedule = capitation fee
  • Deposit that is not refunded = likely a capitation fee
