The RTE Act does not just create obligations for you โ€” it also protects you. Know both sides.

Regularity and Punctuality

24(a)

You must attend school regularly and on time. Persistent absence or late arrival is a disciplinary offence under your service rules.

๐Ÿ’กThis applies equally to all teachers โ€” including those in remote or difficult postings. If you are unable to attend due to a legitimate reason, the proper procedure is to apply for leave through official channels.

Complete the Curriculum

24(b)(c)

You must conduct the curriculum as prescribed and complete it within the specified time (the academic year). Leaving portions of the syllabus untaught is a violation of your duties.

๐Ÿ’กAcademic authorities (NCERT/SCERT) prescribe the curriculum. You are responsible for ensuring every chapter, topic, and learning outcome is covered.

Assess Individual Learning

24(d)

You must assess each child's individual learning ability and provide additional instruction to those who need it. Not every child learns at the same pace โ€” the law requires you to recognise and respond to this.

๐Ÿ’กContinuous Comprehensive Evaluation (CCE) โ€” mandated by Section 29 โ€” is the framework for this. It's not just end-of-year exams; it's ongoing observation of how each child is understanding and applying knowledge.

Regular Parent Meetings

24(e)

You must hold regular meetings with parents and guardians to update them on their child's attendance, ability to learn, and academic progress.

๐Ÿ’กMany parents in rural areas are not comfortable in school environments. Make parent meetings accessible โ€” simple language, no intimidation, and a genuine exchange of information rather than a one-way report.

No Private Tuition

You are prohibited from giving private tuition or coaching โ€” to your own students or to others. This is a complete ban.

๐Ÿ’กThe rationale is important: when teachers earn from tuition, there is an incentive to underteach in school. Full effort in the classroom is the legal expectation.

45-Hour Working Week

Schedule Item 4

Your working week is 45 hours โ€” covering both teaching time and preparation time. This is the minimum standard set in the Schedule.

๐Ÿ’กThis includes lesson planning, assessment preparation, and administrative duties โ€” not just classroom hours.

No Deployment for Non-Teaching Work

You cannot be deployed for non-educational purposes, except for: (1) decennial population census, (2) disaster relief, and (3) elections (Lok Sabha, State Assembly, local body). Everything else โ€” surveys, government schemes, data collection drives, polio campaigns โ€” is illegal deployment.

How to use this protectionIf you are asked to perform non-permitted government duties, you can politely but firmly cite Section 27. Your school head should formally object to the deploying authority.

Protection from Arbitrary Transfer

25(2)

Teachers cannot be transferred away from a school in a way that depletes the school's required Pupil-Teacher Ratio. A transfer that leaves a school below its required strength is a violation.

How to use this protectionIf a transfer order would bring your school below the PTR: the school head and SMC should formally object to the District Education Officer.

Salary and Service Conditions

23(3)

Your salary and allowances are to be prescribed by the State Government. Teacher salary disparities โ€” especially between government and contract/para-teacher positions โ€” are a significant implementation gap that advocates continue to challenge.

How to use this protectionTeacher unions and courts have used Section 23 to challenge disparate pay between regular and contract teachers in several states.

Good Faith Protection

Actions taken honestly and in good faith while implementing the Act cannot be the basis for a legal suit against you personally.

How to use this protectionStandard legal protection โ€” does not cover bad faith actions or wilful violations.

What the Pupil-Teacher Ratio Means for You

The RTE Act mandates specific staffing levels. If your school is understaffed, you have a legal basis to request additional teachers through the SMC or BEO.
